Welcome to Kwinny Sticks & Stones (“we”, “our”, “us”). By purchasing products from us or using our website, you agree to these Terms & Conditions.
1. General
These Terms & Conditions apply to all sales of products and services supplied by Kwinny Sticks & Stones unless otherwise agreed in writing.
We reserve the right to amend these Terms & Conditions at any time. The latest version will always be available on our website.
2. Products
We supply landscaping materials including, but not limited to:
Decorative stone
Gravel and aggregates
Mulch and bark
Sand and soils
Firewood
Garden supplies
Landscape products
Product images are provided as a guide only. Due to the natural characteristics of landscaping materials, colour, texture, size and appearance may vary between deliveries.
Measurements and quantities are approximate unless otherwise specified.
3. Orders
All orders are subject to availability.
We reserve the right to accept or decline any order at our discretion.
Orders cannot be cancelled once materials have been loaded, dispatched or specially ordered unless agreed by us in writing.
4. Pricing
All prices are quoted in Australian Dollars (AUD).
Prices are subject to change without notice.
Unless otherwise stated, prices include GST where applicable.
Delivery charges, pallet deposits or other applicable fees may be added to your order.
5. Payment
Payment must be made in accordance with the agreed payment terms.
For trade customers with approved accounts, payment is required by the due date shown on the tax invoice.
Late payments may incur interest and recovery costs where permitted by law.
Ownership of goods remains with Kwinny Sticks & Stones until payment has been received in full.
6. Delivery
We will make every reasonable effort to deliver goods on the requested delivery date; however, delivery times are estimates only and are not guaranteed.
Risk in the goods passes to the customer upon delivery to the nominated location.
The customer is responsible for ensuring:
Safe and adequate site access
Suitable unloading conditions
Clear instructions for placement of materials
If delivery cannot be completed due to restricted access or customer instructions, additional delivery charges may apply.
7. Collection of Goods
Customers collecting products are responsible for ensuring their vehicle is suitable and legally able to carry the purchased load.
Once goods are loaded onto the customer’s vehicle, responsibility for securing and transporting the goods rests with the customer.
8. Product Quality
Kwinny Sticks & Stones aims to supply products that meet applicable Australian standards where relevant.
Many landscaping products are natural materials and may contain variations in colour, moisture, grading and composition.
Customers should inspect goods upon delivery.
Claims relating to shortages, incorrect products or visible defects must be reported within 48 hours of delivery.
9. Returns and Refunds
Returns are accepted only with prior approval.
Special-order products, opened products and custom-blended materials are generally not eligible for return.
Refunds or replacements will be provided where required under the Australian Consumer Law.
Transport costs associated with approved returns may apply.
10. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
Where goods fail to meet consumer guarantees, customers are entitled to the remedies provided by law.
11. Limitation of Liability
To the maximum extent permitted by law, Kwinny Sticks & Stones shall not be liable for:
Indirect or consequential loss
Loss of profits
Delay in delivery
Incorrect use or installation of products
Site conditions outside our control
Our liability for defective goods is limited to one or more of the following, as permitted by the Australian Consumer Law:
Replacement of the goods
Repair of the goods
Supply of equivalent goods
Refund of the purchase price
12. Force Majeure
We are not liable for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including:
Severe weather
Natural disasters
Industrial disputes
Equipment failure
Government actions
Supplier shortages
13. Website Information
We make reasonable efforts to ensure information on our website is accurate; however, errors may occur.
Product descriptions, pricing and availability may change without notice.
We do not guarantee uninterrupted access to our website.
14. Intellectual Property
